It
has been made imperative for every Vidhan Sabha election
candidate to submit two affidavits along with his
nomination papers. If any information given in these
affidavits is found to be wrong or the candidate conceals
some important information, his papers will not be
rejected. But this will make the concerning candidate
liable for sentence. He may be awarded six months'
imprisonment or fine or both.
As
per provisions of Representation of People Act, giving
wrongful information in the affidavits will cost dear to
the candidate who does so. However, his nomination papers
will not be rejected on this ground. But he or she will
become liable for sentence if he provides any wrong
information about his criminal record and moveable and
immoveable property or conceals some important
information. Under the Act, it will tantamount to election
crime. As per Sub-Sections (1) and (2) of Section 33 of
the Act, there is provision of sentence if a candidate
gives wrong information deliberately, fails to provide
concerning information and conceals some important
information.
