The
candidates aspiring to contest Vidhan Sabha election will
have to submit two affidavits-one regarding their criminal
record and another pertaining to their moveable and
immoveable property. These affidavits will have to be
submitted at the time of filing nomination papers. As per
the instruction of Election Commission of India, copies of
these affidavits will be displayed on the notice board of
the concerning returning officer. If somebody refutes the
information provided by a candidate in his affidavit
through an affidavit, it will also be displayed in the
same manner.
The
Election Commission is committed to ensuring free, fair
and transparent elections. Therefore, it has made it
mandatory to make public the two affidavits filed by the
candidates at the time of filing their nomination papers.
This is also a requisite of Right to Information Act. The
returning officers will not only display these affidavits
on the notice boards of their respective offices, but will
also make copies thereof available on demand. Instructions
have been given to implement these directives on the very
day a candidate files his nomination papers.
If
any one counters the information given by a candidate in
his affidavits through duly submitted affidavits, then
copies of these counter-affidavits will also be put on
display at the notice board. If someone asks for a copy of
a candidate's affidavits, he will be provided the same at
nominal cost. These copies can also be handed to the media
so that these pieces of information can be made public on
a large scale. The returning officer will made the copies
of affidavits available to the District Electoral Officer
at the earliest so that he can give the same at nominal
cost to persons who demand them.
